These Terms & Conditions (the "Terms") govern your use of Build-Fab.com (the "Site") and the ordering, manufacturing, and shipping services offered through it (the "Services"), operated by BuildFab ("BuildFab", "we", "us", "our"). By creating an account, browsing the Site, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or place an order.
Every part on this site is fabricated to the specific dimensions, materials, and options you select in our online configurator at the time of order. It is not a stock item pulled from a shelf — it is built to your configuration, generated from our own parametric part designs. We do not accept customer-submitted designs, drawings, or CAD files for manufacture; every order is built from a part already in our catalog, configured by you within the limits the configurator allows.
You must create an account to place an order. You are responsible for the accuracy of the information on your account and for all activity under it, and for keeping your login credentials confidential. BuildFab is not liable for loss or damage arising from your failure to keep your account secure. You may request deletion of your account at any time by contacting us (see "Contact" below).
It is solely your responsibility to verify, before submitting payment, that the dimensions, quantities, materials, and options you have selected in the configurator are correct for your intended application and will fit and function as you expect. We manufacture the part exactly as configured. We are not responsible for a part that does not fit, mate, or perform as intended because of a configuration choice you made. A generated STEP file is made available before checkout specifically so you can verify the design — review it before ordering, not after the part arrives.
The parametric part designs, generation scripts, and any STEP file, drawing, or CAD data made available to you through the Site are BuildFab's intellectual property. When you place an order, we grant you a limited license to use the resulting STEP file for your own design verification and for use in connection with the part you ordered. It may not be resold, redistributed, or used to manufacture the part through a third party without our written consent.
You may not use the Site or order a part for any illegal purpose, or configure a part that is intended to be used as, or to manufacture, assemble, or complete, any weapon, firearm, firearm part or component, or other item regulated as such under applicable law. BuildFab reserves the right to review, refuse, delay, or cancel any order, at any time and at our sole discretion, including after payment has been made, if we believe it violates this section — you will be notified by email and refunded if the order has not yet entered production.
Prices shown in the configurator are in U.S. dollars and are collected in full at the time your order is placed, through our payment processor, Stripe. We do not store your card details. Sales tax is applied automatically where required by law. We reserve the right to change prices at any time; a price change does not affect an order already placed. Production begins only after payment has been confirmed.
Standard packaging is included with every order. Standard packaging is not guaranteed to prevent minor cosmetic scratching or surface marring in transit. Protective packaging that guards against this is available as a paid add-on, shown and priced at checkout — select it if scratch-free surface finish matters for your application. We are not responsible for minor cosmetic scratches on a part shipped without the optional protective packaging.
We ship to [shipping regions — confirm before launch]. Once your order ships, you will receive tracking information by email and through your account. Title and risk of loss transfer to you once the order is handed to the shipping carrier. We are not liable for delay, loss, or damage caused by the carrier after that point, though we will work with you to help resolve a damaged or lost shipment.
You may request cancellation of an order at any time before it has entered production. Once an order has entered production, it is final — it cannot be cancelled, returned, or refunded, including because a part was configured incorrectly. This does not limit any remedy available to you by law for a part manufactured incorrectly relative to the configuration you actually submitted, or that arrives damaged in transit.
Please inspect your parts promptly upon delivery. If there is a problem with your parts — a manufacturing defect or shipping damage — contact us within 10 days of delivery. You may be asked to provide photos or a description of the issue. Do not ship parts back to us unless we ask you to.
The Site may occasionally contain typographical errors or inaccuracies relating to part descriptions, pricing, or lead times. We reserve the right to correct these and to cancel an affected order, with a full refund, if it has not yet entered production.
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXCEPT AS EXPRESSLY STATED IN THESE TERMS. BUILDFAB WARRANTS ONLY THAT THE PART(S) WE MANUFACTURE WILL SUBSTANTIALLY MATCH THE CONFIGURATION YOU SUBMITTED, WITHIN THE LIMITS OF OUR MANUFACTURING PROCESS. WE DO NOT WARRANT THAT A PART WILL BE FIT FOR ANY PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY ORDER IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID FOR THAT ORDER, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE, INSTALLATION, OR FIT OF A PART YOU ORDERED.
You agree to indemnify and hold BuildFab, its officers, employees, and contractors harmless from any third-party claim arising out of your breach of these Terms, your misuse of the Site or a part you ordered, or your violation of any law or a third party's rights.
These Terms are governed by the laws of [state — confirm before launch], without regard to its conflict-of-laws rules. Any dispute arising out of these Terms will be resolved in the state or federal courts located in [venue — confirm before launch].
We may update these Terms from time to time by posting the revised version at this page. The version in effect at the time you place an order is the version that applies to that order.
